President Donald Trump’s legal team on Saturday, Nov. 21, responded to U.S. Middle District Judge Matthew Brann’s decision to dismiss their lawsuit seeking to block Pennsylvania from certifying its election results.
“Today’s decision turns out to help us in our strategy to get expeditiously to the U.S. Supreme Court. Although we fully disagree with this opinion, we’re thankful to the Obama-appointed judge for making this anticipated decision quickly, rather than simply trying to run out the clock,” campaign senior legal advisers Rudy Giuliani and Jenna Ellis said in a statement.

Brann, an Obama appointee, turned down the request for an injunction by the Trump campaign. Brann said the campaign presented “strained legal arguments without merit and speculative accusations … unsupported by evidence,” and accused them of trying to “disenfranchise almost 7 million voters.”
The Trump legal argued that their witnesses and other evidence showed that 682,777 ballots in Pennsylvania were cast illegally, after poll workers denied the Republican Party’s right to independent review. They said they would seek an expedited appeal to the U.S. Third Circuit Court of Appeals.
“We are disappointed we did not at least get the opportunity to present our evidence at a hearing. Unfortunately the censorship continues. We hope that the Third Circuit will be as gracious as Judge Brann in deciding our appeal one way or the other as expeditiously as possible. This is another case that appears to be moving quickly to the United States Supreme Court,” Giuliani and Ellis said in a statement.
During an interview on Fox News on Saturday, White House press secretary Kayleigh McEnany said “real systematic claims” exist and will be brought before judges. She added that President Trump’s path to victory is the Supreme Court.
“We’ve got to continue fighting this, and the federal courts are the path and, hopefully, up to the Supreme Court, ” McEnany said, “because voter fraud is real, and they seized on a pandemic and created an electoral epidemic—one that was inexcusable, a system that should never have happened.”
