Texas has filed a new federal lawsuit against President Joe Biden, arguing that his policies violate federal law, are not helping the critical overflow situation on the southern border with Mexico, and are also causing a significant influx of illegal aliens infected with the CCP (corona) Virus, endangering public health and the state’s burgeoning economic recovery.
The new legal proceeding, the seventh filed by Texas against the Biden administration since the president’s inauguration, seeks a return to Trump-era border policies.
In addition to the usual complaints about the White House’s disinterest in responding to the thousands of migrants trying to enter the country after the incentives generated by the federal government to make this happen, there is now also a complaint accusing President Biden of deepening the health crisis after failing to comply with the protocols agreed to prevent the spread of the CCP Virus among migrants and to U.S. society.
“President Biden’s outright disregard of the public health crisis in Texas by welcoming and encouraging mass gatherings of illegal aliens is hypocritical and dangerous. This reckless policy change stifles the reopening of the Texas economy at a time when businesses need it the most and when our children need to get back to in-person learning as soon as possible,” Texas Attorney General, Ken Paxton, said in a statement announcing the legal challenge, Fox News reported.
The Biden administration has faced a surge of complaints and denunciations from border states, particularly in Texas, where shocking images have emerged of overcrowded facilities in places like Donna, where migrants can be seen in photos huddled side by side.
Texas officials also have on occasion protested cases where COVID-positive migrants were released into the United States without any restrictions.
It is curious to analyze how Democrats and President Biden himself tried to demonize Texas Republican Governor Greg Abbott for deciding two months ago to lift restrictions against the CCP virus to support the reopening of the economy, betting on the prudent actions of citizens, while now doing nothing to prevent immigrants from being lumped together for days at a time, creating major hotspots of CCP Virus infection, and then releasing them despite knowing they would infect U.S. citizens.
The complaint also accuses the administration of failing to enforce a long-standing federal law that requires immigrants to be detained if they transmit a disease of public health significance.
Critics have accused Biden of making the situation worse by eliminating Trump-era border protections such as the Migrant Protection Protocols (MPPs) and failing to apply Title 42 public health protections to unaccompanied children, whose numbers have grown rapidly in recent months.
The complaint charges that the administration has “hastily and unlawfully departed from their own rules for large numbers of illegal aliens and created an undeniable crisis on our southern border.”
“Instead of using the CDC’s authority to prevent the introduction of covered aliens into the United States during a pandemic, Defendants have chosen to take courses of action that have resulted in the release of tens of thousands of aliens into Texas and the United States,” the lawsuit says. “Absent this Court’s intervention, such releases will continue for the foreseeable future.”
The state of Texas has already sued the Biden administration on a variety of grounds, with this being the seventh such opportunity. Previous lawsuits range from issues tied to the Biden administration’s libertarianism in how it treats illegal immigrants with serious criminal records to issues tied to the White House’s decision regarding suspending the Keystone XL pipeline development projects unilaterally putting the jobs of thousands of citizens at risk.
