Houston police are investigating a mother, believed to be in her late 20s, who is accused of driving drunk when she hit a barrier on Mykawa Road in Houston, Texas, on Saturday, Nov. 9, that left her 3-year-old son died in the crash, KTRK reported.

Police said the woman was driving to her home between 40 and 55 mph with her 8-year-old and 3-year-old sons in the car when she went up on the median and struck the barrier over the creek.

Police responded at around 5:45 a.m.

The 3-year-old was taken to a hospital and pronounced dead. Officers believed the car seat the 3-year-old was in was not the right size for him.

The 8-year old boy is expected to survive but has a broken femur.

The mother was severely injured and was in surgery. 

A preliminary test done at the hospital indicated her blood-alcohol level was about three times the legal limit, according to Sean Teare with the Harris County District Attorney’s Office. She is being charged with felony murder and intoxication assault.

Others could be charged in this case, according to Teare. He wants to know where and how she got so drunk.
