Former Vice President Joe Biden said on Monday, Jan. 20, that he did not consider drunken driving a felony, and that he would not allow Immigration and Customs Enforcement (ICE) agents to deport illegal aliens who get caught drunken driving.

Asked what changes would he bring to ICE agency if he wins the presidency during a 2020 election forum with Vice News, Biden said, “I would hold ICE agents accountable if in fact, they stepped over my executive orders, which is no arrest of anyone outside of the schools,” he said. “You know, look at the—one of the things that’s happening is, particularly for the Latino and Hispanic kids, is the incredible pressure on them in terms of their sense of security.”

“You change the culture by saying, ‘You’re gonna get fired.’ ‘You’re fired,’ if in fact, you do that,” he continued. “You only arrest for the purpose of dealing with a felony that’s committed, and I don’t consider drunk driving as a felony.”

One of President Trump’s zero-tolerance policy toward illegal aliens in 2018 is to make it criminal for illegal aliens to drive under the influence of alcohol. The policy has been unfavored and under attack by Democrats. 

According to ICE’s annual report, half of the 158,000 people arrested by ICE—80,730—were charged or convicted of driving under the influence in 2018, the Washington Examiner reported.

The second-highest category for arrests was for crimes related to “dangerous drugs,” followed by traffic offenses.

Immigration offenses—like having been deported once before—was a common denominator for more than 63,000 of the people arrested.

More than 50,000 people taken into custody had been charged or convicted on assault.

Exactly 23,052 people had faced legal trouble for obstructing judiciary, Congress, legislature, etc.

There have been multiple high-profile incidents in the United States in which illegal aliens have killed citizens while drunken driving. On Nov. 10, 2019, a 67-year-old U.S. Marine vet who served in Vietnam in 1970 and 1971 was the victim of a hit and run by a Mexican national in the country illegally. The alien told police he had consumed seven or eight beers in a restaurant beforehand and was “a little drunk.” The veteran was hit and dragged more than 50 feet. He died at a nearby hospital.
