Texas federal judge Andrew Hanen declared the DACA program illegal. However, president Biden’s administration used the program to give amnesty to illegal immigrants as part of its open borders policy.

“DHS violated the [Administrative Procedure Act] with the creation of DACA and its continued operation … the DACA Memorandum and the DACA program that it created are hereby vacated and remanded to DHS for further consideration, as requested,” Hanen ruled according to Breitbart July 16. 

He added: “DHS … is hereby enjoined from approving any new DACA applications and granting the attendant status.”

Former President Barack Obama approved the Deferred Action for Childhood Arrivals (DACA) program in violation of federal law as only Congress can grant mass amnesty to illegal aliens.

For his part, Supreme Court Justice Clarence Thomas said, “DHS created DACA during the Obama administration without any statutory authorization and without going through the requisite rulemaking process. As a result, the program was unlawful from its inception.”

DACA allowed illegal immigrants brought to the United States as children to defer deportation for two years, renewable, and to obtain work permits, but without the option of citizenship. The beneficiaries are also known as Dreamers. 

Millions of illegal immigrants have availed themselves of it since 2012. Likewise, around 616,000 illegal immigrants are waiting to be enrolled in the DACA program.

The administration of President Joe Biden added new applicants to DACA in an attempt to legalize the residency in the country of countless foreigners who entered in contravention of established immigration laws.

On the other hand, it is noteworthy that at least 2,100 criminal illegal immigrants covered by DACA were removed since 2017, cites The Scoop.

Conservative activist Scott Presler shared the news of Judge Hanen’s decision on Twitter where he wrote, “A Texas federal judge ordered the government to close the DACA program to new applicants, calling it illegal. This is a huge win for every black, white, & brown American citizen, who deserves to come first.”

User Renee Svensson responded, “More wild applause. We are making good advances today.” Svensson was one of many celebrating the decision.

Presler wrote:

Activists pushing for mass illegal immigration protested Judge Hanen’s ruling. 

“This ruling is wrong and is subject to appeal. But Dreamers’ futures shouldn’t be in the hands of the courts,” said Omar Jadwat of the American Civil Liberties Union. 

In this context, people linked to the open borders group “United We Dream” also spoke out about the illegality of DACA. 

The group, linked to George Soros, the billionaire financier of leftist groups worldwide, said the determination was “vindictive and cruel” and called on Democrats to find a way to grant amnesty to illegal immigrants.

The consequences of an amnesty would become a heavy burden on U.S. taxpayers. It would potentially reach $26 billion.

Additionally, 20% would use food stamps, and at least one in seven would go on Medicaid.

Moreover, if passed, the amnesty could trigger a massive wave of illegal immigrants, which is difficult to calculate.
