A group of at least 3,000 pediatric physicians, gynecologists, and healthcare professionals sued the Biden administration for forcing doctors to perform ‘sex change’ surgeries and treatments after the health department included sexual orientation and gender identity under sex discrimination.

The American College of Pediatrics (ACP),, along with the Catholic Medical Association (CMA) and a group of obstetricians and gynecologists represented by the Alliance Defending Freedom (ADF), filed a lawsuit against Xavier Becerra, the current secretary of health and human services,, after the department he heads in May vacated a Trump-era ruling that sex discrimination could only be based on a person’s biological sex.

On May 10, 2021, the Department of Health and Human Services’ Office for Civil Rights (OCR) announced that it would include sexual orientation and gender identity within Section 1557 of the Patient Protection and Affordable Care Act.

Section 1557 states that a patient may not be excluded from participation, denied benefits, or be subjected to discrimination based on race, color, national origin, sex, age, or disability.

According to the Department of Health’s website, June 15, 2020, Supreme Court ruling (Bostock v. Clayton County) determined that discrimination based on sex also encompasses sexual orientation and gender identity.

“Consistent with the Supreme Court’s decision… the OCR will interpret and enforce Section 1557’s prohibition on sex discrimination to include: (1) sexual orientation discrimination; and (2) gender identity discrimination,” the regulations state.

The incorporation of this new interpretation explains OCR will be used to investigate discrimination complaints “but does not itself determine the outcome in any particular case or set of facts.”

With the Health Department’s decision, physicians are required to perform ‘sex change’ treatments and surgeries on those patients who request them,. Otherwise they could receive fines, be excluded from any federal funding program, or lose their medical license.

Dr. Michelle Cretella, executive director of ACP, said in a statement:

“Sex is a medically significant innate and immutable binary trait that is determined by genes at fertilization.”

“No drugs or surgeries can change a person’s sex, but so-called gender transition interventions do cause irreversible damage, especially to youth.”

According to Breitbart, the lawsuit argues that the Biden Administration’s decision forces doctors to set aside their scientific knowledge or judgment to perform treatments that have serious consequences on the development of young people for fear of losing their careers.

According to ACP President Quentin Van Meter, M.D., a pediatrician and endocrinologist, “Puberty blockers and cross-sex hormones combined will sterilize many youth and cause them to develop serious chronic illnesses such as diabetes, heart disease, stroke and cancers that they otherwise would have never experience.”

Other studies indicate that the supply of hormone blockers disrupts normal bone development, causing considerable loss of bone density. Surveys have also detected high rates of suicidal thoughts in young people undergoing these treatments.

In May 2021, a major hospital in Stockholm, Sweden, discontinued hormone treatments due to irreversible side effects.

Karolinska Hospital announced that it stopped administering the hormone-blocking treatment to children trying to ‘change sex’ after several years of being dedicated to diagnosing the psychological condition known as gender dysphoria and providing the treatment to these children.

In its statement to the media, the hospital also indicated that there is currently no evidence that the treatment achieves the desired long-term effect.
