President Trump on Friday tweeted, “All in for Senator Steve Daines as he proposes Amendment for a strong ban on burning our American Flag. A no brainer!”

 Sens. Steve Daines (R-Mont.) and Kevin Cramer (R-N.D.) reintroduced the proposal on Friday, June 14, which was Flag Day.

It calls for the U.S. Constitution to be amended so that “Congress shall have power to prohibit the physical desecration of the flag of the United States.”

“The American Flag is a symbol of freedom—and it should always be protected,” Daines tweeted:

Co-sponsor, Cramer said, “Adding a constitutional amendment to protect this symbol of freedom and liberty is not an attack on another constitutional amendment, rather, it is an affirmation of the unifying principles our nation stands for.”

It is necessary to introduce it as an Amendment because in the past the Supreme Court ruled 5-4 in Texas v. Johnson that burning the American flag is a protected form of freedom of speech, saying that burning the American flag was symbolic speech and was therefore protected by the First Amendment.

In the past President Trump expressed his support to the same ban. He tweeted “Nobody should be allowed to burn the American flag—if they do, there must be consequences – perhaps loss of citizenship or year in jail!”
