California Democratic Gov. Gavin Newson signed a controversial law on Friday, Sept. 11, that will allow judges to not enter child molesters on the California sex offender registry if the defendant can prove minors consented to the activity Breitbart reported.
SB 145 would “exempt from registration” as a sex offender “a person convicted of certain offenses involving minors if the person is not more than 10 years older than the minor and if that offense is the only one that requires the person to register.”
The law would allow a judge to decide whether an adult who engages in certain types of sexual activity with a child should register as a sex offender if that person is within 10 years of the victim who must be at least 14 years old.
State Sen. Scott Wiener of San Francisco, who introduced the bill, said the law aims to end discrimination against the LGBT community because straight people who commit the same crime do not have to register as sex offenders.
However, Dr. Jane Robbins refuted this idea, “If Mr. Wiener were concerned about children, he would push to restore penalties on straight adult predators who prey on minors,” she added. “Instead, he extended the leniency to gay adult predators.”
Robbins told Breitbart News in a statement: ” “The Left wants to sexualize children, period, and to remove penalties for adult predators.”
Politicians from both side of the aisle also condemned the law.
Republican state Sen. Melissa Melendez of California said on Twitter, “Well wHat a shock, Newsom signed SB145, the bill that allows a 24 year old to have sex with a 14 year old and escape felony conviction and requirement to be a registered sex offender. Absolutely disgusting.”

Democratic Assemblywoman Lorena Gonzalez said during debate of the bill, according to the Washington Examiner, “Cannot in my mind as a mother understand how sex between a 24-year-old and a 14-year-old could ever be consensual, how it could ever not be a registrable offense. We should never give up on this idea that children should be in no way subject to a predator.”

The legislation also assumes that teens as young as 14 are capable of fully consenting to sex of any kind with any adult, regardless of sexual orientation.
