Former FBI Deputy Director Andrew McCabe may face the prospect of an indictment after his attorneys were unable to persuade senior Justice Department officials not to pursue charges that he lied to internal investigators.
Two people familiar with the matter said Thursday, Sept. 12, that the deputy attorney general declined an appeal from McCabe’s lawyers aimed at preventing a prosecution. The people weren’t authorized to discuss the issue by name and spoke on condition of anonymity, as reported by The Associated Press.
According to Fox News, U.S. Attorney Jessie Liu recommended to move forward with charges against the Former FBI official. McCabe’s attorneys have argued that he should not face charges on accusations that he lied to internal investigators about whether he had authorized a news media leak in the fall of 2016. McCabe has denied all the allegations.
The Justice Department wrote in an email to McCabe on Thursday—“The Department rejected your appeal of the United States Attorney’s Office’s decision in this matter. Any further inquiries should be directed to the United States Attorney’s Office,” as reported by Fox.
The potential charges against McCabe relate to DOJ findings concerning a Hillary Clinton-related investigation. The Justice Department was investigating McCabe over false statements he allegedly made to the FBI and Justice Department inspector general regarding disclosures of information to the press in October 2016 regarding the Clinton investigation.
McCabe spent 21 years with the FBI. He became the acting director in May 2017 after President Trump fired former director James Comey. The FBI fired McCabe on March 16, 2018, two days before he was set to retire. The FBI’s Office of Professional Responsibility recommended the firing. In response to the firing on March 17 the following day, president Donald Trump tweeted, “Andrew McCabe FIRED, a great day for the hard-working men and women of the FBI – A great day for Democracy. Sanctimonious James Comey was his boss and made McCabe look like a choirboy. He knew all about the lies and corruption going on at the highest levels of the FBI!”
McCabe, who was hired by CNN on Aug. 23, has constantly denied allegations that he lied to investigators. He sued the Justice Department and FBI on Aug. 8, alleging that he was fired from the FBI due to political pressure from President Donald Trump, as reported by the Daily Caller.
After CNN had reported that it had hired McCabe, President Trump responded calling it “disgraceful” and on July 13, the president tweeted “Andy McCabe is a major sleazebag. Among many other things, he took massive amounts of money from Crooked Hillary reps, for wife’s campaign, while Hillary was under “investigation” by FBI!”
